1. Acceptance of Terms

By accessing or using HyperCloud ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

HyperCloud is operated by Hypercluster ("we", "us", "our"). We reserve the right to modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the modified terms.

2. Service Description

HyperCloud is a decentralized, encrypted file storage service. The Service provides:

• Client-side encryption of your files before upload
• Decentralized storage across a distributed network
• File sharing capabilities via secure links
• Account management and storage quota tracking

Beta Status: HyperCloud is currently in beta. Features may change, and the service may experience interruptions or issues during this period.

3. Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your password and recovery phrase
• All activities that occur under your account
• Ensuring your email address is accurate and accessible
• Backing up your recovery phrase in a secure location

Important: Your 12-word recovery phrase is the ONLY way to recover your account if you lose access. We cannot recover your account or data without it.

4. Acceptable Use

You agree NOT to use HyperCloud to:

• Store, share, or distribute illegal content
• Distribute malware, viruses, or harmful code
• Infringe on intellectual property rights of others
• Engage in harassment, abuse, or harmful activities
• Attempt to circumvent security measures or access restrictions
• Use automated systems to abuse the Service
• Store content that exploits minors in any way

We reserve the right to terminate accounts that violate these terms without notice.

5. Storage Limits

Free accounts are provided with 1GB of storage. This limit exists because:

• Storage infrastructure has real costs
• We do not monetize your data through advertising or data harvesting
• We believe in sustainable, honest service provision

Additional storage may be available through paid plans in the future. We reserve the right to modify storage limits with reasonable notice.

6. File Types

For security reasons, certain file types are blocked from upload, including executable files (.exe, .bat, .sh), scripts, and other potentially dangerous formats. This protects all users from accidental distribution of malware.

7. Termination

You may delete your account at any time. We may suspend or terminate your access if:

• You violate these Terms of Service
• Your account is used for illegal activities
• We are required to do so by law
• The Service is discontinued

Upon termination, your data will be deleted from our systems. Due to the decentralized nature of the storage network, complete deletion may take time to propagate.

1. Data We Collect

Account Information:

• Email address (for account management and notifications)
• Password hash (we never store your actual password)
• Recovery phrase hash (we never store your actual recovery phrase)
• Optional: Phone number, wallet address (if you choose to provide them)

Usage Data:

• Storage usage statistics
• File metadata (names, sizes, timestamps) - encrypted
• Basic session information for security purposes

2. Data We Cannot Access

Your files are encrypted on your device before upload. This means:

• We cannot read the contents of your files
• We cannot scan your files for advertising purposes
• We cannot provide your file contents to third parties
• Even in the event of a data breach, your files remain encrypted

This is not just a policy - it is a technical reality of how HyperCloud is designed.

3. How We Use Your Data

We use your information to:

• Provide and maintain the Service
• Send important account notifications
• Respond to support requests
• Enforce our Terms of Service
• Improve the Service (using aggregate, anonymized data)

We do NOT:

• Sell your personal information
• Use your data for advertising
• Share your data with third parties for marketing
• Train AI models on your data

4. Data Retention

Your data is retained as long as your account is active. Upon account deletion:

• Account information is deleted immediately
• Encrypted file data is marked for deletion
• Due to decentralized storage, complete removal may take time

5. Third-Party Services

We may use third-party services for:

• Email delivery (transactional emails only)
• Infrastructure and hosting
• Analytics (anonymized, aggregate data only)

These providers are bound by their own privacy policies and data protection obligations.

Your Responsibility

You are solely responsible for:

• Maintaining backups of any files you cannot afford to lose
• Safeguarding your recovery phrase - write it down and store it securely
• Using a strong, unique password
• Keeping your account credentials secure
• Understanding the risks of using any cloud storage service

Indemnification

You agree to indemnify and hold harmless Hypercluster and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you upload or share through the Service

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.
